TEMPORARY OCCUPANCY LICENSE AGREEMENT
(14-Day Micro-Lodge Transitional Guest License)
THIS TEMPORARY OCCUPANCY LICENSE AGREEMENT (“Agreement”) is entered into by and between the Cooperative Lodge Program / Host (“Licensor”) and the undersigned guest (“Licensee”).
1. PURPOSE & INTENT OF AGREEMENT
This Agreement grants Licensee a temporary, revocable, non-exclusive license to occupy a designated micro-lodge unit for emergency, episodic, or transitional housing support.
EXPRESS ACKNOWLEDGMENT OF TRANSIENT STATUS: Licensee expressly acknowledges, understands, and agrees that:
- The occupancy granted under this Agreement is strictly temporary and transient in nature, governed under California Civil Code Section 1940(b).
- This Agreement creates a revocable license only and does NOT create a tenancy, leasehold estate, or residential tenancy under California law.
- The total duration of occupancy under this license shall not exceed fourteen (14) consecutive days. At no point shall continuous occupancy reach or exceed thirty (30) days.
2. PREMISES & DURATION OF LICENSE
- Designated Unit: Micro-Lodge Unit #_______ (“Premises”)
- Start Date & Time: ________________, 20 at ________ AM/PM
- Termination Date & Time: ________________, 20 at ________ AM/PM (Strict 14-Day Maximum)
Upon the arrival of the Termination Date and Time, this license automatically expires without requirement of further notice. Licensee must fully vacate the unit, remove all personal property, and return unit keys/access credentials.
3. LICENSE FEE & FINANCIAL TERMS
- Daily / Term Fee: $__________ per night / term (or $0.00 if covered under community assistance/endowment).
- Payment Schedule: Due in advance upon execution of this Agreement unless waived in writing by Licensor.
4. LIMITATIONS ON USE & RESIDENCY RESTRICTIONS
To preserve the transient nature of the lodging and prevent establishing legal residency:
- No Mail Registration: Licensee shall NOT use the Premises or Lodge address to receive personal mail, packages, voter registration, or state driver’s license address updates.
- No Permanent Alterations: Licensee shall not modify, alter, or construct additions to the micro-lodge structure.
- No Unapproved Guests: Occupancy is strictly limited to the undersigned Licensee. No overnight guests or unapproved occupants are permitted.
5. CODE OF CONDUCT & OPERATIONAL RULES
Licensee agrees to strictly adhere to the Cooperative Lodge Code of Conduct:
- Community Respect: Practice mutual cooperation and adherence to the “Choose to Be Kind” operational standard.
- Substance & Weapon Policy: Zero tolerance for illegal drugs, weapons, or uncontained hazardous materials on the premises.
- Quiet Hours & Sanitation: Maintain the micro-lodge and surrounding grounds in a clean, sanitary state. Quiet hours are observed between 10:00 PM and 7:00 AM.
- Access for Maintenance: Licensor retains full rights of entry to inspect, maintain, sanitize, and repair the unit at reasonable times with minimal prior notice.
6. TERMINATION, REVOCATION, AND TRESPASS
- Revocation for Cause: Licensor reserves the right to immediately revoke this license prior to the 14-day expiration if Licensee violates any term of this Agreement or the Code of Conduct.
- Surrender of Possession: Upon revocation or automatic expiration, Licensee agrees to peacefully vacate the Premises immediately.
- Status as Trespasser: If Licensee refuses to vacate upon expiration or revocation of this license, Licensee acknowledges that they no longer have permission or license to remain on the property and will be subject to removal as a trespasser pursuant to California Penal Code Section 602. Licensor is not required to initiate judicial Unlawful Detainer proceedings under Code of Civil Procedure Section 1161.
7. ACKNOWLEDGMENT AND SIGNATURES
BY SIGNING BELOW, LICENSEE ACKNOWLEDGES HAVING READ, UNDERSTOOD, AND AGREED TO ALL TERMS ABOVE, SPECIFICALLY THAT THIS IS A SHORT-TERM TEMPORARY LICENSE AND NOT A RESIDENTIAL LEASE.
